Handling Court Cases

Handling cases at court is one of BAZALT Legal Centre’s main areas of business.

We understand the particular nature of a dispute in which one party is a foreign legal entity or individual. Often, disputes between parties can be settled through negotiations or extrajudicial  procedures. But sometimes court proceedings cannot be avoided.

Professional legal analysis of a conflict situation determines the prospects for a judicial examination of the dispute, and helps the client make the right choice – whether to go to court or not.

If we take on a case, we will win it. Although there are situations when dragging out judicial proceedings will only increase the client’s legal fees. Especially when our investigations show that the debtor does not own property against which levies can be executed in the event of a successful suit.

We believe that it is better to honestly warn the client about hopeless judicial proceedings and protect him from unnecessary costs, than to launch proceedings just for the sake of it.

Cooperation between clients and BAZALT Legal Centre specialists in court disputes works in the following way:

• The client gives us all the documents that are in his opinion relevant to the judicial proceedings.
• Our lawyers analyse the documents and evaluate the prospects for judicial proceedings. At this stage they might require additional documents.
• If the client is planning with our help to launch legal action for recovery of money or property from the defendant, we try in the very early stages to evaluate the debtor’s ability to pay and the chances of being able to execute a court order. If our client is the defendant in a case, we will formulate a legal position from which we can win the case, or conclude an amicable settlement on terms beneficial to our client.
• We discuss with the client the prospects for judicial proceedings and together make a decision about whether to file to court or to search for another way to resolve the conflict.
• If the decision is made to begin judicial proceedings, our lawyers will do everything possible to achieve a successful outcome.
